Judicial Challenge Over Guard Activation
In an emergency filing, the justice department pressed the bench to overturn a previous judicial decision that had halted the sending of several hundred military reserve troops to the Chicago area.
The presiding judge had expressed skepticism about the government's justification for activating the guard, doubting its explanation in light of the situation on the ground.
A higher court supported the previous order on midweek, keeping the deployment on standby while the court case continues.
Government's Justifications
The solicitor general, representing the government, wrote in the latest petition that federal agents have repeatedly been âmenaced and targetedâ in downtown Chicago and the outlying area of Broadview community.
This area is home to an federal immigration holding center.
The former president has previously sent state guard personnel to the Windy City and Portland, after earlier activations to LA, Memphis, Tennessee, and the nation's capital.
The president has claimed that armed forces involvement is necessary to curb unrest and strengthen immigration enforcement.
Partisan Pushback
Opposition leaders have pushed back sharply the move, arguing that the administration's assertions are overstated and partisan in nature.
They allege the president of abusing his authority to target political rivals.

Regional authorities claim that demonstrations over ICE activities have been mostly modest and non-violent, contrasting with the presidentâs portrayal of âwar zoneâ conditions.
Legal Basis
At the center of the legal battle is the presidentâs use of a national law authorizing the commander-in-chief to federalize the state guard only in cases of insurrection or when âincapable with the standard military to enforce the statutes of the United Statesâ.
The government argues that the personnel are essential to safeguard government buildings and personnel from demonstrators.

In recent weeks, the administration nationalized three hundred members of the Illinois military reserve and ordered extra Texas-based forces into the state.
As local leaders denounced the decision, the White House escalated his rhetoric, calling on the detention of Chicagoâs mayor and the Illinois governor, both Democrats, accusing them of neglecting to protect ICE personnel.
State authorities and the city of Chicago together took legal action against the government to block the deployment.
On the ninth of October, the presiding federal judge, a Biden appointee, delivered a temporary injunction stopping the directive.
